On behalf of the Windsor Road Residents Group I would like to thank you very much for the time sent with our delegation on Friday.
On, for instance, the question of enforcement, Mr Macbeth seemed to have fallen into the same trap as North Devon District Council in that they both maintain that the enforcement of S106 agreements follow the same laborious route as that of enforcement proceedings taken under Par VII of the Act. This is not the case, S106 agreements are contracts enforceable in the civil courts and do not follow anything like the same path. Enforceability is very much simpler and can be instigated both against the Covenantor and his successors in title.
