I refer to your letters of 14th November and 20th October 2008.
1. There has been no legal advice on this matter.
2. The view is that of the owner. It would be up to the Authority to consider its ability to be successful in undertaking any enforcement action. Part of that consideration is always that of costs in relation to whether the action should have been pursued in the first place.
3. I do not have this information and you would need to obtain this from the Environment Agency.
4. The removal of the wildlife corridor designation from the current Local Plan was undertaken during the Public Inquiry when the Inspector considered that there was insufficient evidence to justify the retention of the designations in the Local Plan. Hence the removal from the 2006 document. Policy ENV8 was substituted instead.
