In order to set the background for our representations we should like to consider the Council's reasoning for abandoning the Wildlife Corridor in favour of non site-specific policy ENV8...
a) whether the abandonment of the site-specified Wildlife Corridor Designation was Officer-led or whether it emerged from a specific objection - if so by whom?
b) whether Devon Wildlife was consulted on the new policy and what were its comments?
c) whether, at any of the consultation stages, representations were made on Policy ENV8
d) did the report of the Planning Inspector adjudicating on the Local Plan make mention of any objections or otherwise comment on or amend the drafting of Policy ENV8?

Your letter of 16th December on which we emailed our acknowledgement. There is much in your letter with which the Group takes issue but we do not think it worthwhile re-opening dialogue on matters that continue taking us into ever decresing circles.
You will be aware that the application on which the inaction debtae presently hangs has been with you for 13 months.
...why we are still awaiting amendments that could arguably have been produced within 14 days of your request.

I would first wish to correct the assertion that a decision not to pursue enforcement action has been made. The resolution of the October 2005 meeting still stands and should circumstances make it necessary or possible, enforcement action will be pursued. However, to do this the Authority firstly has to be satisfied that there is a clear breach of planning control...

You will recall that on behalf of the Windsor Road Residents Group we wrote to you on 23rd October 2009 seeking inter-alia further information on the Officers decision not to pursue enforcement action.... we have at last received a reply from your Landscape Officer indicating that he has discussed matters with you and that it was decided that enforcement action (presumably under both Part II and the S106) would not be expedient... Being that delay is central to the investigation currently being undertaken by the Local Government Ombudsman, the WRRG has asked me to write to both yourself and the Ombudsman expressing its concern over this continued inaction and seeking clarification of certain points....

Further my acknowledgement letter of 30th October 2009 I have now discussed the matter with the Planning Manager and I am happy to advise you that the taking of further enforcement action has not been discarded as stated in your letter, but that it has been decided that formal action would not be expedient until such time as the application to vary the existing 106 agreement has been considered by the Council's Planning Committee.

I note your clients remaining concerns regarding the perceived lack of recognition on the importance of the Bradiford Valley for nature conservation in the context of Policies DVS6, ENV8, ENV10 and ENV12 and whether these policies will provide the necessary protection to the existing wildlife and biodiversity in the area.

The Windsor Road Residents Group has forwarded to me a copy of the Case Officer's letter of 9th October. Whilst I agree that representations concerning the outstanding application to modify the S106 agreement should be directed to the Case Officer, there are several related matters that demand action higher up the chain and it is for this reason that we have directed certain parts of our correspondence to you and to the Head of Planning.
