It seems to us that you believe that we are a signatory to the S106 Agreement.
Flood Risk/Development Control - We visited the stretch of watercourse on the 12th December 2007 and we have no undue concerns following the visit. The Bradiford Water is designated as non main river at this location.
The only other thing he saw was a larger mound of spoil towards the centre of the site. This does not cause us any conservation concerns. The owner's landscaping contractor is endeavouring to re-address the unacceptable features created by the previous owner.
We suggest that you express your concerns to North Devon District Council and Devon Wildlife Trust because we "believe" they have the powers or interest regarding "the tipping" of such material in an area which is "designated as a North Devon network site relating to the local plan biodiversity policy ENV8".
(Note - The Planning Liaison Officer, Environment Agency, does not clarify whether this is the private domestic curtilage or the designated flood plain
